Protective Covenants Overview

Association Members Should Be Knowledgeable Of The Covenants, Restrictions And Limitations Of Shiloh Falls Subdivision.

Due to the complexity of Protective Covenants, the Board has summarized major restrictions that are the “most common violations” and provided the referenced paragraph numbers for additional details. Please help maintain the community atmosphere by adhering to these guidelines.

Enforcement Procedures of SFHA Rules and Regulations

To ensure compliance with the Covenants, By-laws, and Rules & Regulations, the SFHA Board of Directors follows these procedures to address violations:

Compliance Requirement

All homeowners and property owners must adhere to the provisions of the By-laws, Covenants, and Rules & Regulations. Non-compliance may result in actions to recover damages, suspension of voting rights, suspension of recreational facility access, foreclosure of liens, or any other legal actions deemed necessary.

Notification of Violations

If a rule or regulation is violated, the member will be notified by first-class mail or a hand-delivered notice outlining the violation and actions required by the Association. The notice will be delivered to the address on file.

Immediate Action for Health or Safety Violations

In cases where a violation presents a health or safety hazard, the Board may take immediate corrective action at the member’s expense. Notification of actions taken and incurred costs will be sent via first-class mail.

Right to Enter Property

The Board of Directors and Architectural Committee are authorized to enter any lot at reasonable times to inspect and ensure compliance with the guidelines, especially regarding construction, alterations, or other structures.

Appeal Process

Members have the right to appeal a violation citation. Appeals must be submitted in writing within ten (10) days of receiving the violation notice. The appeal will be reviewed by the Board of Directors.

Final Decision

Once an appeal is heard, if the Board’s decision stands, the member will be informed of the actions required to correct the violation (e.g., legal action). The Board’s decision is final.

Common Restrictions and Guidelines

Fences

All fences within Shiloh Falls must be approved by the Architectural Committee. This ensures that the aesthetics and overall neighborhood appearance are maintained. Please submit a request for approval prior to installation.

Fireworks and/or Firearms

The discharge of fireworks or firearms is strictly prohibited within Shiloh Falls. This is to ensure the safety and tranquility of the community for all residents.

Garage Sales & Carport Sales

Garage sales and carport sales are expressly prohibited in Shiloh Falls. This policy helps maintain the residential nature of the community.

Golf Carts

Golf carts are permitted to be operated by individuals who are eighteen years or older. Please ensure that golf carts are used responsibly and safely within the community.

Lease/Rental of Homes

Homes within Shiloh Falls may only be leased for periods of six months or longer. This ensures that properties are not frequently turned over and supports long-term residency.

Mailboxes

All mailboxes within Shiloh Falls must be approved by the Architectural Committee. This helps maintain a uniform and appealing appearance throughout the subdivision.

Lawn Mowing & Maintenance

Property Maintenance Guidelines

Each Shiloh Falls Homeowner is responsible for maintaining the appearance of their landscaping by mowing and trimming around their homes. Lack of mowing, trimming or removal of dead brush, construction material and unused vehicles, is unreasonably detrimental to adjoining property owners and to the neighborhood. If such a situation exists, the SFHA may make arrangements, to enter upon the property and have the work completed, in which case the cost and expense of such work, including incidental expenses, filing fees, miscellaneous charges and reasonable attorneys’ fees incurred by SFHA, will be added to the cost of such work.

Community Rules and Regulations

Please review the following important guidelines that help maintain the integrity, safety, and beauty of the Shiloh Falls community. Adhering to these regulations ensures a peaceful and harmonious living environment for all residents.

Motorcycles

No motorcycles, three-wheelers, four-wheelers, all-terrain vehicles, or similar vehicles are allowed to operate within Shiloh Falls. The only exception is golf carts, which may be operated by individuals eighteen years or older.

Nuisances

No noxious or offensive trade or activity is allowed on any lot, nor should anything be done that could become a nuisance or annoyance to the neighborhood.

Parking on Shiloh Falls Streets

Parking on Shiloh Falls streets is prohibited on a regular or habitual basis. Vehicles parked in areas obstructing the mowing of SFHA right-of-way or in unsafe positions may create a traffic hazard. Homeowners must use garages or driveways for their vehicles.

If a homeowner hosts a large group event, they must notify Security in advance. During the event, visitors may park on the street near the host’s home.
Vehicles violating these rules are subject to towing at the owner’s expense.

Pets

Residents may keep pets, but they must be maintained in a manner that does not create a nuisance. Pets should be confined to their property or on leashes when outside.

Solicitation

Solicitation and posting of flyers or notices in Shiloh Falls are prohibited. This includes items placed in mailboxes, on homes, or on car windshields.
